1. Agreement and acceptance

These Terms of Use are a contract between you and Seyfi Can Zeyrek (“we”, “us”). By downloading, opening, or using the app, or by continuing on the paywall after the notice that you agree to the Terms and Privacy Policy, you agree to these Terms.

Please read the Privacy Policy. It explains how we process data and is incorporated by reference in section 13.

2. Definitions

App means Tourist City Itinerary Planner for Android and iOS.
Stores means the Apple App Store and Google Play.
Premium means the lifetime in-app purchase entitlement or an active 3-day app-granted trial.
Content means itineraries, city guides, packs, and media we provide.

On iOS, Apple is not a party to this contract except as a third-party beneficiary under section 5.

3. Eligibility and age

You must be at least 13 years old. If you are under the age of majority where you live, you may use the app only with a parent or guardian’s permission.

4. Account

The app creates an anonymous identifier through Firebase Authentication. You do not register a name or password. That identifier is still an account-like ID for analytics, crash reports, and purchases. You may request deletion as described in the Privacy Policy.

5. License (including Apple minimum terms)

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control.

Apple App Store (iOS)

If you obtained the iOS app from Apple:

These Terms are between you and Seyfi Can Zeyrek only, not with Apple. We, not Apple, are solely responsible for the Licensed Application and its content.

The license is non-transferable and limited to Apple-branded products that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms (including Family Sharing where Apple allows it).

We, not Apple, are solely responsible for maintenance and support. Apple has no obligation to furnish maintenance or support.

To the maximum extent permitted by law, if the Licensed Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are our sole responsibility.

You acknowledge that we, not Apple, are responsible for addressing claims relating to the Licensed Application or your possession and use of it, including product liability, failure to conform to legal requirements, and consumer protection or privacy claims. These Terms do not limit our liability beyond what applicable law permits.

If a third party claims that the Licensed Application or your possession and use of it infringes intellectual property rights, we, not Apple, are solely responsible for investigation, defense, settlement, and discharge of that claim.

You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms when using the app (for example your mobile network terms).

You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

Google Play

If you obtained the Android app from Google Play, your use is also subject to the Google Play Developer Distribution Agreement as between Google and us. These Terms do not bind Google and do not grant you rights against Google beyond Google’s own terms.

6. System permissions

You may grant or refuse location, notifications, and (on iOS) tracking. Location permission does not currently mean we read GPS. You may revoke permissions in system settings. The planner still works without location.

7. Service description and limits

The app generates walking-oriented city itineraries and shows city-guide content for selected destinations.

Limits:

Coverage is limited to destinations we publish; lists can change.
Walking times, opening hours, and tips are estimates and can be wrong or outdated.
We do not book tickets, hotels, or transport, and we do not guarantee entry.
Firebase, Apple, Google, RevenueCat, or AdMob outages can interrupt content, ads, or purchases.
The 3-day trial is stored on the device; clearing data or reinstalling can end it.
Lifetime access is checked through RevenueCat and the Stores; checks can be delayed.
We do not automatically confirm visits, award location rewards, or track you on a map in this version.
Third-party maps, venue sites, and transport apps are not our services.

The app is an informational travel aid. It is not an emergency, medical, visa, or accessibility guarantee service.

8. Health and safety

The app is not a medical device and does not provide health or fitness coaching. Walking suggestions can be inaccurate. You assume the risks of travel and outdoor walking. Do not rely on the app in an emergency.

9. Purchases and trial

Paid access is a one-time lifetime in-app purchase processed by Apple or Google through RevenueCat (product lifetime / package $rc_lifetime, entitlement TouristicTripCityPlan Pro). It does not renew automatically on a billing cycle.

A 3-day trial may be granted by the app on the device. It is not a Store introductory subscription. After the trial, premium features require the lifetime purchase or a restore of a previous purchase.

The price on the paywall is the live Store price. If the Store price cannot be loaded, the app asks you to retry; we do not invent a price.

Refunds and billing disputes are handled by Apple or Google under their rules. We do not promise a direct refund except where the law requires us to. Restore purchases using the in-app restore control with the same Store account.

Premium feature details may change. There is no in-app “cancel subscription” control because billed access is a one-time unlock.

EEA/UK: for digital content, you may lose the 14-day withdrawal right if you ask for immediate access and acknowledge that you lose that right. Store policies still apply.

10. Advertising

The free tier may show Google AdMob app-open, interstitial, and rewarded ads. Premium (trial or lifetime) is ad-free in the current build. Personalized ads require consent where the law requires it (UMP; iOS ATT). We do not guarantee particular ads. Rewarded ads may unlock a preview as shown in the UI.

11. User conduct

You will not scrape, reverse engineer except as allowed by law, disrupt the service, use the app on a device you are not allowed to use, or violate export or sanctions laws (see section 5 for the iOS representation).

12. Intellectual property

We and our licensors own the app, guides, and packs. You receive a license, not ownership. Destination names and third-party marks belong to their owners.

13. Privacy Policy

Our Privacy Policy explains data practices. If these Terms and the Privacy Policy conflict on a data issue, the Privacy Policy controls for that issue.

14. Disclaimer of warranties

THE APP AND CONTENT ARE PROVIDED AS IS AND AS AVAILABLE. We do not warrant uninterrupted service or any travel outcome. Mandatory consumer warranties that cannot be excluded remain.

iOS warranty refunds through Apple are described in section 5.

15. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or lost-profit damages, or for missed bookings, denied entry, injury, or disruption caused by relying on the content.

Where liability can be limited, our total liability is limited to the greater of (a) amounts you paid for the licensed application in the 12 months before the claim or (b) USD 50 if you paid nothing.

This does not exclude liability for death or personal injury caused by negligence, fraud, gross negligence, or any liability that cannot be limited under the laws of Türkiye, the EEA, the United Kingdom, or your country of residence.

16. Indemnification

If you misuse the app or violate these Terms, you will indemnify Seyfi Can Zeyrek against resulting third-party claims and reasonable costs, except where consumer law in your country prohibits that.

17. Termination

You may stop using the app and uninstall it. We may suspend access if you materially breach these Terms. On-device data is removed when you uninstall. Cloud identifiers are deleted as described in the Privacy Policy. Store records remain with Apple or Google.

18. Dispute resolution

Email sczgamesinfo@gmail.com and wait 30 days for an informal resolution before filing a claim.

These Terms are governed by the laws of the Republic of Türkiye, excluding conflict-of-law rules. Mandatory consumer protection laws of your country of residence remain in effect.

Courts of İzmir, Türkiye, have non-exclusive jurisdiction. If you are a consumer in Türkiye, the EEA, or the United Kingdom, you may also bring claims in the courts of your place of residence. Small-claims procedures where you live remain available. These Terms do not say that other courts are invalid.

There is no arbitration clause and no class-action waiver.

19. Changes

We may update these Terms. The last_updated date will change. Continued use after the update constitutes acceptance where allowed by law. For material changes we will provide additional notice when practical.
